Abstract

Background. The article is devoted to one of the most important directions of the state policy that is the problem of criminal policy modernization. The article identifies the priorities of the contemporary Russian criminal policy, among which an important role is played by the process of its humanization. Humanization of punishment acts is an integral part of the liberal criminal policy. The goal of the study is to analyze the most important directions of modernization of the criminal law policy.
Materials and methods. Implementation of the research objectives was achieved on the basis of the all-round analysis of the economies of repression, crime prevention and recovery nature of criminal policy. The methodology includes the methods of comparative and legal analysis.
Results. The author investigated formation and development of the doctrine of modernization of the criminal policy. The author supposes that the liberal trend of the Russian criminal policy has a pragmatic explanation, because the state cannot ensure application of the system of criminal punishment.
Conclusions. The central problem of reforming the criminal policy is the issue of effectiveness of the criminal legislation. The promising directions of the decision of the specified problem, according to the author, are the economies of repression, crime prevention and recovery nature of the criminal policy. Without implementation of the identified reform measures of the Russian criminal policy it is impossible to realize the ideas of democratic and legal state.
